    A work permit, officially called an Employment Authorization Document (EAD), allows eligible immigrants to work legally in the United States. The EAD is a physical card that proves you have permission to work, and it's obtained by filing Form I-765 with USCIS.     Who Qualifies for a Work Permit?

    The EAD is available to immigrants in specific categories. The most common include applicants with a pending adjustment of status (green card) case, DACA recipients, students with economic hardship, asylum applicants, TPS holders, and certain visa holders. Each category has its own eligibility code that you must enter on the I-765.

    Documents You Need to File the I-765

    Your I-765 package should include the following:

    • ✓Completed Form I-765 with the correct eligibility category.
    • ✓A copy of your I-94 arrival/departure record or other entry evidence.
    • ✓A copy of your passport photo page and any prior EAD.
    • ✓Two passport-style photos taken within the last 30 days.
    • ✓Proof of your qualifying category (pending I-485 receipt, DACA approval, etc.).
    • ✓The filing fee of $410, or a fee waiver request if eligible.

    How to Complete Form I-765

    The I-765 asks for your personal information, eligibility category, and prior immigration history. The most important field is the eligibility category code — entering the wrong one is a common reason for rejection. If you're filing based on a pending I-485, the category is usually (c)(9). DACA applicants use (c)(33). Double-check your category before submitting.

    How to File and What to Expect

    You can file the I-765 online or by mail. After filing, you'll receive a receipt notice within 2 to 3 weeks. Biometrics may be required. Processing times vary by category and service center, but most EADs are approved within 3 to 7 months. Once approved, your work permit card arrives by mail and is typically valid for 1 to 2 years, depending on your category.

    Renewing Your Work Permit

    EADs expire, so you must renew before the card expires to keep working without interruption. USCIS recommends filing your renewal 6 months before expiration. You'll file a new I-765 with updated supporting documents and the renewal fee. Some categories, like pending adjustment of status, allow you to file renewal with no fee if your I-485 is still pending.
